Family of terrorist were informed at 11pm, District Court also lifts suppression​

Another urgent hearing was held at at the Auckland District Court in front of Judge Peter Winter on Saturday morning in relation to the terrorist's name suppression.

The family of the terrorist were not informed until 11pm on Friday, his lawyer Davoud Mansouri-Rad said.

Mansouri-Rad told the judge he has informed the family via email and is awaiting instructions.

Crown prosecutor Brian Dickey indicated he would be seeking a stay of the District Court charges by the Solicitor-General.

The man was facing a charge of assault and injuring with intent to injure in relation to an incident in 2020.

Judge Winter has also lifted the man's suppression on the same basis as Justice Edwin Wylie ordered at the High Court.

Justice Wylie gave the family 24 hours to file opposition to this order, which will expire at 11pm on Saturday.

The Indian women is not Muslim so It was a hate crime pure and simple. No different from a white supremist using the skinhead movement as a vehicle for their hate. You'd be hard pressed to think of a hate crime that wasn't attached to some sort of movement or religion, it's what evil people do to justify their actions in their own mind.

This coward picked Lynnmall for a reason, if he tried the same thing at the Kelston Countdown, the female shoppers there would've beaten him to death. In fact he would've had to walk past the Kelston Countdown to get to the Lynnmall Countdown.

Karen's are too lazy to be terrorists, it's too much like hard work. They'll be telling everyone how the terrorist isn't doing their job properly behind their back though, "You know Akbar? I heard he doesn't even want to kill the infidels. Don't tell anyone I said this but I heard he's actually half infidel himself!"

Ardern has got political issues with how to address this as solution put forward will be against her underlying ideology.

The calls will be lock them up, deport them, don’t let them in, go hard on criminals… etc

- Her reputation is anti Australia deporting criminals.
- Her reputation is soft on crime and gangs
- Her reputation is preferring to keep people out of jail and reduce the prison population
- Her reputation is pro refugees that Australia’s wouldn’t accept due to them breaking the rules.

It will be interesting politically how she navigates this, especially the contrast to Australia.

Think it is disingenuous of PM JA to say it is speculative whether the soon to be terror law amemdment would have stopped this individual.
By all accounts this is the exact type of case it is designed for..

Terrorist charged with attacking Corrections officers while awaiting trial for Isis material​

The supermarket terrorist was facing charges in the district court after allegedly attacking Corrections officers inside Mt Eden Prison.

Stuff understands the man was being held on remand in June 2020 while awaiting trial in the High Court when he got into an argument with officers.

As a result he was charged with injuring with reckless disregard and assault with intent to injure.

Crown prosecutor Brian Dickey is now seeking a stay of proceedings of those charges.

The government had already copped criticism for bringing in an act in response to the Christchurch Attack which wouldn’t have prevented it. The act hasn’t prevented this one.

But I wonder how far an act like this can actually go. Unless someone is deemed such a danger to society that you prevent them from owning a gun or stop them from buying things necessary to build a homemade bomb. But does that then prevent them from being able to purchase a computer or laptop in case they access objectionable material. Do we stop them from buying a prepaid phone in case it gets used to activate a remote detonator? They can‘t buy a car because they may drive it up the footpath? No fertiliser for the garden because it might be used as an explosive? Can‘t allow people to buy petrol, glass bottles, matches and shirts in case someone makes home made Molotov cocktails?

I wonder at what time the current legislation came into force yesterday. Was it during the planning, preparation or execution of his cowardly act. Some reports say he used a knife as a weapon he picked up off a shelf while others say he took it with him.

If he picked it up there, then when did our current terrorism law kick in? It seems not when he was planning it by walking into the store and towards where the knives were (unless he just saw the knives and “snapped”…. which we’ll never know). Was preparing the moment he picked up a knife…. but anyone can do that in a store and it not be considered an act of terrorism. Once he made his first moment towards his first victim with an intention of attacking them or the moment the blade touched his first victim?

I don’t actually see that there is anyway that an act like this could have been prevented. He was under constant surveillance by armed undercover, no doubt, highly trained officers who had no hesitation at ending his life. Unless they find evidence where he lives or on electronic devises we most likely won’t know anymore about his motivation except he had been radicalised.

I honestly don’t know the answer on how you write a law preventing this sort of cowardly attack which didn’t seem to have much in the way of planning.

Do we just have to accept that acts like this may occur and they are the cost we pay for the freedoms we enjoy? At what point do we decide everyday activities are planning something like this?

You can only manage risk you cannot prevent anyone from doing something like this unless your remove them from society all together, and likely permanently.

What the Police stopped so far....was this terrorist succeeding in killing people.

I read a comment in Al Jazeera "Any time you stop an ISIS attack from killing people is a good days work, the New Zealanders should be commended not criticised".

However we despise it these are belief systems, not mental or even criminal in the usual sense. To me once they are identified there has to be a threshold where they cannot be in society.

Then, where do we put tem, personally I do not think Civil prisons are the place. Too much risk of indoctrination. Interested to get Dave's view. I would prefer a military prison, Soames Island springs to mind.

I am a strong advocate for deporting these people, like you stated in your first post.

Get rid of them. Send them home.

It costs a lot of money to keep these people in jail hey.

I think that would be dead right too, but I think there were other reasons he chose LynnMall, mainly easier to give the Police the slip...just IMO

This is from WION Gravitas, the Indian news website.

It shows a more extended video showing a guy with a white hat running through the supermarket.

They said he was the attacker but I don't think so, he would have been one of the cops. He was running towards where the knives were.

However they note this comes just after ISIS K scored in Kabul. I doubt it is coincidental either.

Have to feel for the victims obviously. But also the people there who managed to escape as they were there doing their weekly shop.

Then there is the staff. They have a hard enough job at the moment as it is working as an essential worker during a covid outbreak. There would be PTSD going back to work and seeing the area where it occurred.
